End User License Agreement (EULA)

This End User License Agreement (EULA) grants you a limited, non-exclusive, non-transferable, revocable right to install and use Arkyra software strictly within your purchased entitlement and applicable plan limits.

This is a license of use only. No ownership right, title, or proprietary interest in the software is transferred to you under this EULA.

Arkyra software, source and object code, architecture, user interface, documentation, visual assets, trademarks, and all related materials are protected under Turkish Law No. 5846 on Intellectual and Artistic Works (FSEK), international copyright conventions (including the Berne Convention), and other applicable intellectual property laws.

All rights not expressly granted are reserved by Arkyra and its licensors. Unauthorized use constitutes infringement and may result in immediate termination, injunctive relief, and civil or criminal remedies where available by law.

Except to the narrow extent expressly required by non-waivable mandatory law, you must not reverse engineer, decompile, disassemble, decode, scrape, modify, adapt, or otherwise attempt to derive source code, trade secrets, or underlying models from the software.

You must not bypass technical protection measures, remove proprietary notices, create derivative works intended to replicate Arkyra functionality, or use Arkyra to develop competing products or services.

Arkyra may apply reasonable technical and contractual controls to verify seat counts, entitlement scope, and anti-abuse compliance, consistent with applicable privacy and data-protection law.

If material misuse, over-deployment, or circumvention is detected, Arkyra may suspend or terminate access, disable affected license keys, and seek contractual or statutory remedies.

Certain software components may be provided under third-party open-source or commercial licenses. Those components remain the property of their respective owners and are governed by their applicable license terms.

In the event of conflict regarding a third-party component, the third-party license terms apply to that component only; all other portions remain governed by this EULA.

Updates, patches, compatibility releases, and support response levels depend on your active plan and commercial agreement. Arkyra may change, improve, or discontinue features for security, legal, or technical reasons.

No update or support commitment exists beyond what is explicitly stated in your order, subscription, or enterprise contract.

To the maximum extent permitted by applicable law, the software is provided on an "as is" and "as available" basis, without implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

Arkyra is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, except where liability cannot be excluded under mandatory law.

This EULA terminates automatically if you breach its terms. Upon termination, you must immediately cease use and uninstall or disable all unauthorized deployments.

Sections regarding intellectual property, restrictions, disclaimer, liability, dispute resolution, and any payment obligations survive termination.
